1. General

These Terms cover your right to access, and the terms governing such access, your Pawland account (“Account”), donation services (“Donations”), and various services and tools provided by Pawland (“Pawland Portal”) in connection with said Account (“Services”). The parties to these Terms are you (being either a private individual or an authorized representative of a company) and Pawland.

2. Account

By signing up for a Pawland Account and accepting these Terms, you are granted a limited, royalty-free, revocable, non-assignable right to use your Account.

This Account is personal, and you expressly agree not to share your username or password with any third party or to allow any third party to use or access your Account. The only exception to this are shared organization Accounts (”Organization Account”).

By registering an Account you represent and guarantee that you are/represent the party for which the Account (including an Organization Account) is intended. It is strongly prohibited to register Accounts on behalf of third parties without the prior written consent of Pawland.

3. Services

By signing up for an Account or visiting Pawland, you are granted a limited, revocable, royalty-free, non-assignable right to use the Services. Such Services may include, for example, the Shelter Management Portal (“My Portal”, “Portal”) or search functionality. Services may be taken offline or added from time to time at the sole discretion of Pawland.

Terms applicable in particular to My Portal: for the avoidance of doubt, it is expressly prohibited to register a shelter on behalf of other shelter workers or owners. By registering a shelter on Pawland, you represent and guarantee that the data you have provided is correct, and that the shelter belongs to you or to the organization or company you officially represent. By publishing needs, posts, animals and events on behalf of the shelter, you warrant that the data you provide is truthful, valid and does not break any laws or regulations.

4. Donations

We will use your donation at our discretion but within our stated charitable objectives to provide maintenance and development of the Platform.

All payments through the Website are to be made by payment card via Donorbox (see Donorbox terms).

Once you confirm to us through the Website that you wish to proceed with your donation your transaction will be processed through our payment services provider, Donorbox. By confirming that you wish to proceed with your donation you authorize Donorbox to request funds from your credit, debit, Apple Pay, Google Pay providers or any other provider Donorbox supports.

4.1 Unauthorised card use

If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

4.2 Information from you

Before we can process a donation you must provide us with your email address and details of the credit or debit card that you wish to use to fund the donation. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.

When you submit your payment details, these details will be transferred to our payment provider, Donorbox, and your payment data will be collected and processed securely by them. You should make sure that you are aware of Donorbox’s terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal data before you make a donation.

We won’t share your personal details with any other third party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.

4.3 Refund policy

If you make an error in your donation please contact us either by email at contact@pawland.org.

4.4 Monthly donations

These Donation Payment Terms and Conditions will only apply to successive donations made through the Website where you have set up a monthly donation. When you set up a regular donation you will be scheduling a series of donations to be made on the day of the month that you choose until further notice. You agree that these Terms and Conditions will apply to each of the donations in that series.

By confirming that you wish to proceed with a monthly donation you authorize our payment service provider Donorbox to request funds from your credit or debit card on the day of each month that you set.

To cancel your regular donation please check the email from the Donorbox or contact us at contact@pawland.org.

4.5 General

We reserve the right to amend these Donation Payment Terms and Conditions at any time.

5. Limitations of use

Your right to use the Account, Donations and Services is subject to these Terms and to the following limitations. Any violation of the below limitations shall be recognized as a material violation of the Terms.

No illegal/immoral content: You commit not to upload, or to keep on your Account or in the Services any information that could be deemed illegal, obscene or otherwise in violation of public morality, including content that demonstrates an abuse of an individual or animal, or violates the intellectual property rights of third parties or relevant privacy or competition law provisions.
No fraudulent representations: You commit not to fraudulently represent any third party, or to use Services without the legal right to do so.
No fraud: You commit not to use the Services to do wrongful or criminal deception intended to result in financial or personal gain.
No spam/mislead behavior: You commit not to behave in the way to spam or mislead our community and users.
No abuse: You commit not to do any hateful behavior, hate speech, or promotion of hateful ideologies. This includes content that attacks a person or group because of protected attributes, including but not limited to caste, race, religion, sex, gender, disability, sexual orientation, national origin, tribe, gender identity, immigration status or serious disease.
No animal exploitation: You commit not to demonstrate or promote animal abuse, cruelty, neglect, trade, or other forms of animal exploitation.
No dangerous activities: You commit not to demonstrate or promote in any way dangerous activities and challenges, suicide or self-harm, bullying or harrassment and any other activities that may cause harm to animals or people.
No bullying: You commit not to use language or behavior that harasses, humiliates, threatens, or doxxes anyone. This also includes responding to such acts with retaliatory harassment (but excludes non-harassing counter speech).
No malicious use: You commit not to maliciously use the Account, Danations or Services in such a way that potentially hinder the availability or integrity of the Pawland Services or other Pawland content or services, including carrying out a denial of service attack (DDOS) or uploading or sharing malicious codes or softwares.
No unreasonable reports: You commit not to submit appeals, reports, notices or complaints which are manifestly unfounded.
No inappropriate use of material included in the Account or Services: You do not have the right to use any material included in the Account or Services for any other purpose except to use the Account/Services. No license is granted to you to any intellectual property rights of Pawland or its licensors in any material included in the Services and Account, including copyright in the source code of any programs relating to the Services and Account, copyright in the marketing pictures and pictures and descriptions of services and service documentation.
No sharing of account: As defined in Section 2.
No reverse engineering: You shall not attempt to reverse engineer or otherwise render into human readable form or obtain a copy of the code relating to the Services or Account.

6. Personal data and privacy

The processing of your personal data is covered in a separate privacy statement, accessible here: Privacy Policy. The data controller for such processing is Pawland, and data is furthermore processed by various processors subject to written data processing agreements with Pawland.

7. Availability of account, donations and services

Pawland will commit to keep the availability of the Account, Donations and Services at an sufficient level and provide a separate contact point for service and help requests. However, Pawland does not give any particular availability guarantees or guarantees regarding response or support ticket handling times. Access to the Account or Services may be unavailable due to the need to update or fix the Account, Donations and Services, or for any other reason at the sole discretion of Pawland.

For the avoidance of doubt, it is your responsibility as a user to ensure that your browser and equipment are up to date and able to access and use the Account and Services as intended, and that your browser and equipment have a sufficient level of data security, and Pawland assume no responsibility or liability for the above.

8. Accuracy and credibility of the content

Pawland is not responsible for the content provided by other users, including but not limited to shelter information, animal information, shelter needs, posts, events, geolocation etc. All the responsibility for the content lies on the publishers (shelter owners and contributors) who publish their content on Pawland.

9. Violence of agreement and damages

In the event of a material violence of these Terms on your part, Pawland shall have the right to immediately terminate the Terms and your right to use the Account, Donations and Services without advance notice.

Pawland shall not be responsible or liable for any indirect damages caused to you in relation to these Terms or the Pawland Account and Services. We are not liable for any event which was reasonably beyond our control, or any losses or damages which were done by other users or registered shelters or their representatives.

10. Changes to terms

You accept that Pawland may unilaterally change these Terms by uploading a new copy of the Terms into Pawland and notifying you of the same. In the event you continue to use your Account or Services after receiving such a notification, you will be deemed to have accepted the changed Terms as binding upon you. If you disagree with the revised Terms, you can delete your Account. If you do not delete your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Pawland will be subject to the revised Terms.

11. Term and termination

Your right to use the Account, Donations and Services shall commence after you have registered your Pawland Account and accepted these Terms or started to use this website anonymously and continue indefinitely. In the event you materially or repeatedly violate these Terms or are deemed not to have accepted the Terms as binding upon yourself, Pawland has the right to terminate your right to use the Account and Services without advance notice.

In the event of termination or expiry of these Terms or your right to use the Account, Donations or Services, you shall immediately stop to use the Account/Donations/Services, and any data uploaded into Pawland by you will be deleted, subject to relevant personal data legislation.

12. Applicable law and dispute resolution

The legal relations between the User and Pawland arising from the use of the Platform are applied by the legal acts of the Republic of Estonia.

The number of arbitrators shall be one and the place of arbitration shall be Tallinn, Estonia.
